Terms of Service

This is the agreement between you (the customer) and pebblesites (us). We tried to write it in plain English, because anyone signing a contract should be able to read it.

What you're hiring us for

We design and build a custom website for your small business, ship it within the timeline on the pricing page, and either hand it over or keep running it. Depending on which plan you picked.

Essential ($699 one-time or $99/month)

  • 3 custom pages, mobile-first, your logo & photos, a contact form, basic SEO setup
  • Delivered in 5 days from kickoff

Plus ($1,499 one-time or $149/month)

  • 8–12 custom pages, bookings/payments/e-commerce, full copywriting, advanced SEO, custom animations
  • Delivered in 7–10 days from kickoff
  • 1 month of launch support included

"Kickoff" means the day after you've paid the deposit (one-time) or your first month (monthly) and sent us the materials we asked for (logo, photos, copy, etc.). The clock pauses if we're waiting on you.

What you owe us

One-time: 50% on kickoff, 50% on launch day. We don't start until the first half is paid. Optionally, we accept three installments by request.

Monthly: billed on the same day each month. First month is charged on kickoff. Cancel anytime.

If a one-time payment is more than 30 days late after launch, we may temporarily disable the site and/or charge a late fee of $50/month until paid. We've never had to do this.

Revisions & scope

Two rounds of revisions are included on every plan. In practice we keep iterating until you're happy. We don't watch the clock on revisions during the build. After launch, small edits (under ~30 minutes) on Essential are billed at $95/hr; on monthly, they're included.

If you add a feature that's clearly out of scope (e.g. you bought Essential and now want e-commerce), we'll quote separately. We won't surprise-bill you.

Ownership

One-time: on launch day, you own the full source code, all design files, and all content we created for you. We retain the right to:

  • Show the site in our portfolio (only if you've agreed. We ask)
  • Reuse generic patterns/components we authored (CSS reset, button component, etc.) on other projects

Monthly: we host and own the running deployment. Your design, content, and code-as-built are licensed to you for use exclusively on your site. If you cancel, we transfer ownership of the code to you and unbind the deployment.

What you own

You own:

  • All content you give us (logos, photos, copy)
  • Your domain name
  • Your customer/visitor data
  • Your accounts on any third-party tools (Stripe, Mailchimp, etc.)
  • After launch / cancellation, the website code itself

You're responsible for making sure you have the right to use everything you give us (logos, photos, etc.). If you give us a stock photo you didn't license, you're the one on the hook for it, not us.

Refunds

One-time:

  • Full refund if you don't like the first preview (48 hours after kickoff)
  • Partial refund based on work completed after that, up to launch day
  • No refund after launch. The site is live and you're benefiting from it

Monthly:

  • Cancel any month. No refund on the current month
  • We send you the code on the way out

If you're unhappy and not in any of the above buckets, talk to us. We've never had a dispute we couldn't resolve in a single email.

Cancellation

Email info@pebblesites.com with "cancel" in the subject. We'll confirm within one business day and:

  • If monthly: bill you for the current month, then nothing after. Send you the code within 7 days.
  • If mid-build: we'll pause the build, calculate the refund based on work done, and refund within 14 days.

Things we can't promise

We can't promise:

  • That your business will get more customers because of the website (we can promise a great site, but we can't promise sales)
  • 100% uptime. We use top-tier hosting (99.95%+ in practice) but no host hits 100%
  • Specific search rankings. Google does its own thing. We do the SEO foundation; ranking depends on competition, content, time
  • That third-party tools we integrate (Stripe, Calendly, etc.) won't change their APIs and break things. When they do, we'll fix it (free on monthly, hourly on one-time)

If something goes wrong

If we mess up. Site down, broken feature, missed deadline. Tell us. We'll fix it as a priority. If our mistake costs you money, talk to us; we'll make it right within reason. Our total liability for any project is capped at what you've paid us for that project. We carry general business liability insurance.

Termination by us

We reserve the right to terminate the agreement if:

  • Payment is more than 60 days late and we can't reach you
  • You ask us to do something illegal (this hasn't happened)
  • The relationship has become abusive. To be specific: harassment, repeated personal insults, or demands outside the scope of professional collaboration

If we terminate, we'll refund any payment for work not yet done and hand over whatever's complete.

Disputes

We strongly prefer to resolve disputes by email. If that fails: mediation in the state of [our state of incorporation]. We are not going to drag this into court if we can help it.

Changes to these terms

If we change these terms, the new version applies to new customers immediately and to existing customers 30 days after we email them about it.
